The recent flare-up between the militant group Hamas and the state of Israel has led observers to ask whether the two warring factions are presently committing war crimes. It is alleged that Hamas uses civilians as human shields, while Israel uses disproportionate force to execute the war.

The International Criminal Court launched an investigation into possible war crimes relating to the last war between the two. Incidentally, the two are already using the same tactics perceived as war crimes.

Hamas and its other affiliated Palestinian groups indiscriminately fire rockets into Israel without consideration for civilian populace. Israel on the other hand often exert absolute force with the purpose to hurt and decapacitate. Incidentally, Gaza is a coastal strip with two million people packed together in a dense urban terrain. The possibility of civilian casualty is absolutely impossible.
